The Trial of Islamic Regime of Iran

January 9, 2007

The

Federal District Court, WashingtonD.C.

Defendants (defaulted):

1. Ali Akbar Hashemi Rafsanjami (Former President)

2. Ali Aakbar Fallahian Khuzestani

3. Islamic Republic of Iran

Plaintiff: Gholam Nikbin

Lead Council: Dr. William F. Pepper

Case Number: 04 CV00008

Time & Date: 9:30 AM, January 9, 2007

Place: Judge John Bates Courtroom, the

Federal District Court, Washington D.C

Contact Person: Dr. Mohammad Parvin. He will testify at the trial session as an expert witness.

Background:

In September 2003, after several years of hard work, MEHR Iran announced the filing of a lawsuit against the Islamic Regime of Iran (IRI), the Iranian Ministry of Intelligence and Security, the Islamic Revolutionary Guard Corps, Ali Akbar Rafsanjani, and Ali Akbar Fallahian Khuzestani. The announcement was made at a conference at the FURAMA Hotel in Los Angeles. This conference was organized by MEHR to commemorate the 1988 massacre of political prisoners in Iran.

The lawsuit filed by the San Francisco-based Center for Justice & Accountability (CJA), charged that agents of the Islamic Regime of Iran tortured the plaintiff, Gholam Nikbin, 59, who served three years in jail for his conversion to the Mormon faith and for permitting dancing at his wedding. Nikbin was whipped with an electric cable on his bare soles and hung upside-down during interrogation and punishment by Iran's security forces in 1990. The torture damaged his kidneys and made walking difficult. He is still suffering physically and physiologically.

Nikbin told hundreds of Iranian Americans gathered at MEHR conference that he hoped his lawsuit would make his homeland "ashamed, and they will hear my voice”. When asked whether he was not afraid of the terrible consequences of suing the Islamic Regime of Iran, Nikbin said to hundreds of audiences:

"I do not care about my life. I want the whole world to hear my voice and know what they did to me. I am still suffering from what they did to me. I do not want this to happen to another Iranian. I want to free my country from these terrorists."

UN assembly accuses Iran of numerous rights abuses

By Irwin Arieff

UNITED NATIONS, Dec 19 (Reuters) - The U.N. General Assembly expressed "serious concern" on Tuesday about a long list of human rights abuses attributed to Iran and urged Tehran to ensure full respect for those rights.

A resolution was adopted by a vote of 72-50 with 55 abstentions in the 192-nation assembly after it narrowly defeated a motion by Iran to take no action on the measure.

The resolution expressed the assembly's "serious concern" at Tehran's "harassment, intimidation and persecution" of human rights champions, interest groups, political opponents, religious dissenters, journalists, parliamentarians, students, clerics, academics, Internet bloggers and labor union members.

It criticized Iran's justice system, which it says has "persistently failed" to meet international standards and faulted Tehran for using torture and public executions and discriminating against women, girls and ethnic and religious minorities.

It called on the Iranian government to ensure full respect for the rights to assembly and free speech, end its harassment of rights activists and political opponents, stop using torture and ensure full respect for due process of law.

Iran is frequently attacked for human rights abuses, including hanging juveniles, inflicting other cruel punishments including flogging and amputation, imprisoning political dissidents and closing newspapers and Internet sites.

Iran, supported by Pakistan and Zimbabwe, tried to head off adoption of the resolution by urging the assembly to instead approve a motion to take no action on it. U.N. members voted 81-75 with 24 abstentions to reject that motion.

Canada and Finland criticized Tehran for offering a "no action" motion for a second time after a similar procedural ploy failed last month in the assembly's Social, Humanitarian and Cultural Committee, which screens human rights resolutions for the full assembly.

The General Assembly action came as U.N. Security Council members negotiated a separate resolution put forward by Britain, France and Germany to impose sanctions on Tehran over its nuclear program.

The Security Council measure is a reaction to Iran's failure to comply with an Aug. 31 U.N. deadline to suspend uranium enrichment, which can produce fuel for nuclear power plants or for bombs. Iran says it only wants to produce electricity while Western governments believe its activities are a cover for bomb-making.

'There will be sanctions' on Iran, says French FM

PARIS (AFP) - The powers making up the UN Security Council are agreed that "there will be sanctions" against Iran, though their extent is yet to be decided, France said, after a Paris meeting on Tehran's nuclear programme.

"There is a question as to the extent of the sanctions, but there will be sanctions," Foreign Minister Philippe Douste-Blazy told RTL radio Wednesday.

He said the five permanent UN Security Council members plus Germany "agree on one thing: that there will be a United Nations Security Council resolution backed by all, including China and Russia.

Kalbasi’s poetry is generous and abundantly human, passionate and compassionate.

-- Jimmy Santiago Baca, award winning poet, and author of Immigrants in Our Own Land

Sheema Kalbasi’s poems speak of love, loss, and life in exile. They are the poems of a human rights activist passionate with the hope of peace. Kalbasi’s poetry exposes the deep heart of a woman who is compassionate with suffering and full of the joy of life, of the innocence of a child, the knowledge of a woman, the aspirations of a peacemaker. These are stirring poems with a worldly view, both accessible and imaginative. They make an excellent cross-cultural exchange that demonstrates our universal humanity.

-- Daniela Gioseffi, American book award winning author of WOMEN ON WAR: INTERNATIONAL WRITINGS.

Already, this new century seems as deafened by ideological clamour as the last, plagued by residues of cultural and literary separatism sometimes bordering on a kind of 'aesthetic apartheid'. For nations increasingly brought face-to-face across cultural divides - chasms that are now as much internal as external - the need for conversation, on its many levels, has never been more essential. Poetry, with its potential for radical openness and self-revelation, is an ideal prompt and vehicle for that conversation. Many kinds of voice continue to lie dormant in the English-speaking world; but we have at least begun to witness, in more recent times, some breakings of silence. In its quiet, intimate way, 'Echoes in Exile' reverberates with that desire to speak up. Of Iranian descent, Kalbasi is one of a swelling stream of poets now beginning to establish the conversation's many-sidedness.

-- Dr. Mario Petrucci, award winning poet and writer

Sheema Kalbasi’s poems attest to our tragic situation in which exile becomes a privileged position for pointing out the prevalent injustice of displacement. Her deeply engaging and reflective poems allow us to wrest away the very idea of homecoming in a world that denies it.

PETITION: The FIFA Ruling Must Include Women Football in Iran

View Current Signatures - Sign the Petition

To: FIFA

Dear Mr Joseph S. Blatter

FIFA's decision to ban the Islamic Republic's football teams from international games is a brilliant decision and should have come about a long time ago. The ban is because of the interferences that the Iranian Football Federation is experiencing from the regime. The main reasons for FIFA's ban are that the regime is interfering with the decision -making and appointments of the leadership of the football association, which is supposed to be an independent entity in order to maintain the non-political status of the International Football Association. However, you must be aware the interference of the regime does not end with the decision-making and appointments of the association's leadership: the regime interferes with almost every aspect of the football and all other sports in Iran. The regime appoints an observer for not only the football association but also all the football clubs and other sport clubs to ensure the imposition of the arbitrary Islamic codes and ethics, which often hinder the exercising and competitiveness of the sport. For example, Iranian women football players have to cover the whole of their bodies in order to be able to play. This is not only degrading to our women but also it hinders and affects their competitiveness and efficiency of their game. It affects them psychologically too as it gives them a sense of inferiority. On this basis, the game is unfair before it starts. It also makes the competition unfair in the way that if the temperature is high the team with less clothing have the advantage. FIFA must ensure fair play and if the Islamic regime carries on imposing degrading Islamic codes on our women football players then the ban should continue until the regime complies with the international standards that govern all members and participating teams. The imposition of arbitrary Islamic codes on our men football players affects their game, more or less, in the same way too.

Therefore, we undersigned would like you to make the FIFA's stance clear to the Islamic regime that If they want to participate in the international arenas, they must abide by the uniformity of the international standards that govern all members - standards that ensures fair play not only physically, but also mentally and psychologically. International Football will only be fair if both teams are on equal footing. Iranian football player whether male or female are not on equal footing because of the censorship and imposition of Islamic Codes that are not necessarily Islamic but only a version interpreted by present rulers in Iran.

We, undersigned, support FIFA to end all interferences from the regime and to bring Iranian football on to an equal footing in the International football arena.

Sincerely,

The Undersigned

Hezbollah

It is absurd to close your eyes
and pretend that the Bahais
have never been slaughtered or forced
to convert to Islam,
as if the executions of political prisoners
or the Kurds were just part of a game,
an unwritten law in a lawless land.

Extended customs, mute prayers,
grave to grave, Tehran cemeteries
black from the flesh of the youth
and on the faces of the mothers lay
chipped beliefs and spreading tears.

The News shows the Godzilla regime
- mourning over the tassels of demolished
homes of the homeless in a country
not even close to my land - sits on tinplates
of power and announces another castration.

This perhaps is a blessing from God
that when there is a Friday Prayer in Tehran,
we still cry over the Arab-Israeli War.

It is the forbidden faith in post revolution Iran.

Dear Friends,

As you know, Google website after a big lie in changing the name of Persian Gulf to Arabian Gulf, unfortunately this time by publishing fake information about Tabriz city in Iran which Google company inculcated that in Azerbaijan, again it made a huge harmful for Iranians, reality, and also to trust of all people all around the world which accept that as a honest website.
For complain against these lies propagation, we need your help and your confirmation from all around the world. Below, there is the text of petition which will be offered to United Nations, U.S. Department of Justice, and also big news agencies all around the world.

Dear Dr. Eric Schmidt,
Chairman of the Executive Committee and Chief Executive Officer of Google Company

Regards to your new fake information about Tabriz city in Iran which your company, Google, inculcated that in Azerbaijan, I would like to inform you that, after a big lie in changing the name of Persian Gulf to Arabian Gulf, unfortunately it is second time which Google made a huge harmful for Iranians and also to trust of all people all around the world which accept Google as a honest website.
I should inform you; Iranians all over the world whether exist in Iran or immigrated, whether agree with their government or not, whether graduated or non-graduated, whether Muslim, Christian, Zoroastrian or Jewish, whether Azeri, Kurd, Baloch or Arab, whether young or old, man or woman, love their homeland and are strongly patriotic. We will not let to any other country or company to violate our land, our country and our history. Of course our country is in a bad condition, but I should say that according to history of Iran, this brave land has been much more dangerous conditions as it has now, but its valiant men kept it alive along these ups and downs of history so their sons will keep it alive up to Persian race is alive.
It is clear that these activities have one goal which is separating Iran and Iranians and ruin our union. But you should know; history is light as sunlight, by staining this white paper and publishing lies which has goal to change history, you just lead to every body all around the world know your website and your company as a liar and faker which publish lies instead of reality. It is very clear in history of 4000 years ago, 2000 years B.C.; Tabriz city and also Persian Gulf, were, are and will be inseparable parts of Iran.
Be careful these affaires just destroy your credit and not any more. Because the world has been changed, nowadays free humans have ability on thinking and of course they will think and judge your published data.
I as an Iranian guy condemn this second lie of Google against Iran and also mind power of every body all around the world. Lie is a big insult to thinking power of human. دوستان عزیز;

Confessions of huge bribes to Europeans

Confessions of huge bribes to Europeans: "Mr. Chirac cannot dance with our enemies and at the same time wink in our direction and all the while pillage from the share of all Iranians."

http://zaneirani.blogspot.com/2006/11/blog-post_13.html

Iran Press News translated Iranian press reports that admitted that major bribes had been paid to European countries to attract their support and cooperation with Tehran’s regime. An excerpt:
"Mr. Chirac cannot dance with our enemies and at the same time wink in our direction and all the while pillage from the share of all Iranians."
The full text:
The regime-run newspaper Jomhuri’yeh Islami in an article entitled "We ought to be the ones who start the sanctions", admitted to major bribes paid to European countries to attract their support and cooperation with Tehran’s regime, writing: "Mr. Chirac cannot dance with our enemies and at the same time wink in our direction and all the while pillage from the share of all Iranians."

This newspaper added: "There are new development in the action against the case of the Islamic republic’s peaceful nuclear activities. Britain, France and Germany’s "fact-finding committees" would visit Iran with various excuses, in order to find a proper solution for interaction with the Islamic Republic; later as mediators, they tried to wangle unilateral concessions from us and in return made baseless commitments and now they not only threaten us but they bellow louder than the United States. No one has forgotten Jacques Chirac’s nuclear threatens [against us] in those hot summer days. France which has not yet corrected it’s position, never did explain that situation and never did apologize and has taken up an attitude with Iran that so far not even America has dared to take, in addressing us. Today France is on the list of countries that has a direct role in the draft resolution against us and in order to resolve it’s issues with the U.S. during recent years has tried to make Iran the scapegoat."

The newspaper continued: "The importance of emphasis on this point is to know that France, in recent years has most benefited from the lucrative Iranian market and they are still trying to grab the biggest share of the delicious Iranian economic cake for themselves. Paris knows that with the 25 billion euro investment in Iran over the past 15 years it has claimed a remarkable place within Iran’s economy but we have to make Paris leaders comprehend that "double dealing is not on". Mr. Chirac cannot dance with our enemies and at the same time wink in our direction and all the while pillage from the share of all Iranians. The circumstances over the oil and gas contracts and their car manufacturing is a subject that if scrutinized clearly shows nothing more than a total unilateral profit off of Iran and Iranians by the French. A more than 60% return on gas contracts with Iran, usually whets the appetite of the always hungry French and in relation to the French automobile manufacturing contracts, despite their commitments, they have not been willing to leave the exporting to Iranians and once again, in their unilateral manner of dealing, Iranians merely put the company’s marketing in the hands of the opportunist French. France with the presence of a lucrative market in Iran has established a cozy racket. In fact Paris with it’s ever-growing and clearly reckless presence in Iran’s marketplace is trying to simultaneously safeguard its’ interests both inside and outside Iran. And meanwhile, precisely it is with these concessions that France remains the only country that has made the most insulting and vicious atomic threat against Iran. If no problem arises from the sanctions then Paris will certainly profit from its most lucrative market in Iran, further filling its’ bulging pockets and if there are sanctions, it will find a way to chisel the United States for it’s economic losses and stroke Washington for concessions. This is exactly the reason why Paris should be warned and let them know that we’ve seen Mr. Chirac and his aides’ hand and that we are cognizent that they lost the necessary qualifications for a broad and unlimited presence on the Iranian market a long time ago. By pushing France out of the the profitable Iranian market, let’s show others that political and economic ties with Iran requires accountability and the special rules and regulations must be observed to the letter. That Mr. Chirac made an atomic threat and participated in organizing sanctions against Iran, simultaneously reaching his hand onto the Iranian table is definitely unacceptable and intolerable.”

A letter to the People of the World, United Nations, UNESCO and International Federation for Human Rights

Ladies and Gentlemen,

It is almost two years that thousands of people interested in the historical and cultural heritages of human kind have pleaded for your help to save a large part of archeologically unique sites of Iran, recognized as a part of human heritage, from complete destruction by the flooding of a Dam called Sivand.

These threatened areas are comprised of Bolaghi Gorge, Pasargad Plains and the Mausoleum of Cyrus the Great, the author of the first Human rights charter. According to reports prepared by excavators, geologists, environmentalists, archeologists and historians, all published inside Iran, flooding the Sivand Dam will not only destroy all the historical treasures of this area but it will also jeopardize the environment and agriculture of a vast region in Iran's Fars province.

Now, the Ministry of Energy in Iran, with the consent of Organization for Historical Heritage of that country, the very establishment that is to preserve such treasures, intends to flood this area regardless of all the above grave consequences.

The International Committee to Save Pasargad, addresses your civilized and loving consciousness to do whatever you humanely can to prevent this cultural and human disaster from happening.

With Love and Regards

Subject: Urgent Action for the Release of Mehdi Sanjari

Salute,

Mehdi (Kianoosh) Sanjari, 23 years old, is a human rights activist in Iran who has been arrested during disturbances in Tehran. He is one of those activists who spread the news about political prisoners and especially the imprisoned university students through his web-log. On the 7th of this October, when Sanjari went to the place of the disturbance to compile the news on the spot, he was arrested by the security agents and taken to the section 209 of the Evin Prison. He is now kept in an individual cell and no information is available about him. Detention in an individual cell is considered a violation of human rights. Sanjari is one of the activists of the nineties who was expelled from the university for his activities in the political and student organizations. He was a member of an organization named the United Students’ Front, which is known as an active organization in the field of human rights in Iran. We, the Human Rights activists in Iran, are extremely worried about the situation of Mehdi Sanjari and request you, the Human Rights organizations and activists throughout the world, to take urgent action for the release of Sanjari. We emphasize that freedom of conscience and speech is a fundamental human right that the government of Iran has violated. We insist that you, the Human Rights organizations and activists, make contacts with

the Government of Iran and ask them to free Mehdi Sanjari. Sanjari is only one .example of the human rights activists who, as a result of lack of democracy and suppression of free thought in Iran, is facing such problems.

Respectfully,

Activists and Students for Human Rights in Iran

Sincerely,
